Data Collection

Private data is collected for the purpose of debt collection and customer service and may come from information that you provide directly to Merchants’ Credit Guide or is provided to Merchants’ Credit Guide from third parties

The type of personal information that is collected may include:

  • Contact information, such as name, email, address, and telephone number

  • Username and password

  • Health information related to services rendered

  • Financial data, including debtor status or collection, conditions.

  • Call recordings

Data Usage

Your private data is used only for the intended purposes for which it was collected and only when implicit or explicit consent has been obtained unless a law or regulation specifically requires otherwise. Private data is currently retained within secured systems for no less than 180 days and no more than 10 years. Policies and procedures have been implemented to protect private data from erasure or destruction during the specified retention period of the information and erasure is restricted to authorized personnel, uses secure methods to ensure private data cannot be recovered, and actions are logged. Private data no longer retained is anonymized, disposed of, or destroyed in a manner that prevents loss, theft, misuse, or unauthorized access.

Privacy Options and Access

Merchants’ Credit Guide allows you the ability to access or correct their stored private data for review and can provide electronic or physical copies upon request. Merchants’ will provide the reason if unable to meet that request.

Disclosures and Notifications

Any disclosure of your private data must be approved by you prior to Merchants’ Credit Guide sharing the data. Privacy policies or other specific instructions or requirements for handling private data are communicated to third parties to whom private data is disclosed.
Private data is disclosed to third parties only for the purposes for which it was collected or created and only when implicit or explicit consent has been obtained from the data subject unless a law or regulation specifically requires otherwise.
Private data is disclosed only to third parties who have agreements with the entity to protect private data in a manner consistent with the relevant aspects of the entity’s privacy notice or other specific instructions or requirements. The entity has procedures in place to evaluate that the third parties have effective controls to meet the terms of the agreement, instructions, or requirements.
Private data is disclosed to third parties for new purposes or uses only with the prior implicit or explicit consent of data subjects.
Merchant’s creates and maintains a record of disclosures of private data that is complete, accurate, and timely and includes the types of private data and sensitive private data and the related processes, systems, and third parties involved in the handling of such information are identified.
Merchants’ has procedures in place to evaluate that the third parties have effective controls to meet the terms of the agreement, instructions, or requirements and takes remedial action in response to misuse of private data by a third party to whom the entity has transferred such information. Merchants Incident Response Policy provides the processes for providing notice of breaches and incidents to affected data subjects, regulators, and others to meet the entity’s objectives related to privacy.
